1.Acceptance of these terms
These Terms of Service (“Terms”) form a binding agreement between you and [Legal entity name](“Cytross Nursing”, “we”, “us”, or “our”) governing your use of the Cytross Nursing web application and its supporting API (together, the “Service”). By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2.Eligibility
The Service is intended for adults and nursing students preparing for a professional licensing examination. You must be at least 16 years old (or the minimum age required in your jurisdiction, whichever is higher) to use the Service. By using the Service you represent that you meet this requirement and that the information you provide during registration is accurate.
3.Account responsibilities
- Registration. You must provide a valid email address and choose a username and password. You must verify your email address before your account is fully enabled.
- Public username. Your username is a public handle that other users can search for in order to send friend requests. Do not include private information in it.
- Account security. You are responsible for keeping your password (and any two-factor authentication method) confidential and for all activity under your account. Notify us promptly at

We store passwords only as an irreversible hash and cannot recover them for you; use the password-reset flow if you forget yours. - One account per person. Accounts are personal to you and may not be shared, sold, or transferred except through the subscription-share feature described in Section 5.
4.Acceptable use
You agree not to:
- copy, scrape, harvest, crawl, bulk-download, or otherwise systematically extract the questions, answer keys, rationales, lectures, or other content of the Service, by any automated or manual means;
- circumvent, disable, or interfere with rate limiting, authentication, or any other security or access-control feature of the Service;
- share, republish, or distribute Service content outside the Service;
- attempt to gain unauthorised access to any account, system, or data;
- use the Service to infringe any law or the rights of others, or to harass or abuse other users through the social features;
- use the Service in a way that imposes an unreasonable load on our infrastructure or disrupts other users.
We operate technical controls to detect and prevent automated harvesting of the question bank, and we may suspend or terminate accounts that violate this section.
5.Referrals and subscription sharing
The Service includes a subscription-share referral feature. You may invite other people to Cytross Nursing using a share link, and an associated share percentage (share_pct) may be recorded for the referral relationship. When an invited person registers through a valid invite link, a friendship is created between you and them.
Important: the referral feature currently records referral relationships and share percentages, but monetary payout of referral or subscription-share rewards is not yet available. Recording a referral or a share percentage does not create any present entitlement to a payment, discount, or other benefit. We may introduce, modify, condition, or discontinue any referral rewards at our discretion, and any future rewards program will be subject to its own terms. You may not create fake accounts, self-refer, or otherwise abuse the referral feature. Invite links expire and are single-use.
6.Intellectual property
All content made available through the Service — including the question bank, answer keys, rationales, Deep Review lectures, case studies, the adaptive engine and its outputs, and all software, text, graphics, and branding — is the proprietary property of Cytross Nursing or its licensors and is protected by intellectual-property laws. Except for the limited, personal, non-exclusive, non-transferable right to use the Service for your own exam preparation, no rights are granted to you. You may not reproduce, distribute, create derivative works from, publicly display, or commercially exploit any Service content, and you may not extract or reuse the question bank in whole or in part (see Section 4).
Content you submit — for example, item flags/reports — remains yours, but you grant us a worldwide, royalty-free licence to use it to operate, secure, and improve the Service (including for content quality assurance).
7.Disclaimers
- Educational tool only. The Service is a study and self-assessment tool. It is not the NCLEX examination and is not a substitute for professional instruction, clinical training, or your own judgement.
- No guarantee of results. Adaptive practice, progress reports, readiness bands, and any performance indicators are statistical estimates based on your activity. They are presented with their inherent uncertainty and do not guarantee that you will pass the NCLEX-RN® or any other examination. We make no representation as to any specific outcome.
- No professional advice. Nothing in the Service constitutes medical, legal, or professional advice.
- “As is.”The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
- Trademark / non-affiliation. NCLEX®, NCLEX-RN®, and NCLEX-PN® are registered trademarks of the National Council of State Boards of Nursing, Inc. (NCSBN®). NCSBN does not endorse, and is not affiliated with, Cytross Nursing.
8.Limitation of liability
To the fullest extent permitted by law, Cytross Nursing and [Legal entity name] will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or examination outcomes, arising out of or relating to your use of (or inability to use) the Service, whether based in contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of [amount, e.g. the amount you paid us in the 12 months before the claim] or [minimum amount].
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
9.Termination and account deletion
- By you. You may stop using the Service at any time. You may erase your study history using the in-app erase-history feature, and you may request deletion of your account and identity data as described in the Privacy Policy. Because of the Service’s identity / behavioural data separation, deleting your identity can leave your past study responses in an anonymous, non-identifying form.
- By us. We may suspend or terminate your access if you violate these Terms (for example, by harvesting content or abusing the referral feature), if required by law, or to protect the Service or other users. Where reasonable and lawful, we will give you notice.
- Effect. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — survive.
10.Governing law
These Terms are governed by the laws of [Jurisdiction / governing law], without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in [Jurisdiction / governing law] for any dispute arising out of or relating to these Terms or the Service, except where applicable law grants you the right to bring proceedings in your own jurisdiction.

We may update these Terms from time to time. When we make material changes, we will update the “Effective date” above and, where appropriate, notify you through the Service or by email. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
